Everyone seems to have different opinions on this. I have read that it's actually not legal to download copies of a game you have, but you are allowed to make a backup FROM the copy you own, e.g. dumping the ROM.

Edit: I should add it may depend on the company, the country, and as you say, the particular console.

It seems to be something of a grey area and as KC says, nobody cares anyway. Especially not for older consoles, although I wouldn't want to risk downloading ROMs for current generation consoles. But maybe I'm just being paranoid (:
