Nope. It's not even a stew.
Unless you make your cereal from boiling the milk, in which case you may be on to something. But soup requires boiling something to get the base essence/oils out, whether animal bones, shells from shellfish, or vegetables. |
Gazpacho said FU VLADY. There are tons of cold, chilled, uncooked soups out there.

Incorrect- check out a recipe for gazpacho and the first step:

Fill a 6-quart pot halfway full of water, set over high heat and bring to a boil.
Make an X with a paring knife on the bottom of the tomatoes. Drop the tomatoes into the boiling water for 15 seconds, remove and transfer to an ice bath and allow to cool until able to handle, approximately 1 minute. Remove and pat dry. Peel, core and seed the tomatoes. When seeding the tomatoes, place the seeds and pulp into a fine mesh strainer set over a bowl in order to catch the juice. Press as much of the juice through as possible and then add enough bottled tomato juice to bring the total to 1 cup.

Just because it is served cold doesn't mean the base wasn't boiled originally.

You can use stewed tomato right out of the can if you refuse to believe that raw gazpacho exists or any gazpacho outside that one recipe. (They do exist, btw).
I will stop here for a quick cereal lesson:
Cereal doesn't grow out of the ground. It is usually a grain or grains that is ground, pressure cooked, reformed, then baked. Your argument dies there. Even whole oats are cooked.
If that's not enough, there are plenty of completely raw soups out there.
Cereal, otoh, is not a soup. | |

I guess you could call cereal a soup ingredient if you had to, but in cereal and milk, the milk is more like a sauce than a soup base. | |

Somebody boiled those tomatoes, even if you didn't. That's the equivalent of saying "You can use broth right out of the can!"- somebody still boiled some bones and/or meat for it to get there.
The primary definition of soup is:
"a liquid dish, typically made by boiling meat, fish, or vegetables, etc., in stock or water."
The secondary definition is:
"a substance or mixture perceived to resemble soup in appearance or consistency."
Gazpacho that is raw will likely fall under the second, but nobody is really going to say that breakfast cereal looks like soup except DS, and he thinks he only has eight fingers.
