Lets start by a legal definition of fraud:

A party who has lost something due to fraud is entitled to file a lawsuit for damages against the party acting fraudulently, and the damages may include punitive damages as a punishment or public example due to the malicious nature of the fraud.

There was no loss here nor was his goal to deprive the investors of their money. There was no malicious nature here. There's a fucking reason he's not getting sued by investors. Use common sense here, if nobody is hurt here is there really fraud being commit? Nobody fucking lost anything. Investors made 3x/5x ROI. He is guilty of lying to investors about his Hedge Fund performance, which is clearly wrong. But he still made right by everyone. This should be a civil case between him and Retrophin. I work for a firm whose entire INDUSTRY is based off of trust in investments. I work for a Big 4 accounting firm. You know why we exist? Because investors have to trust what is going on with businesses. I can't even have a credit card balance with a company we audit over $10k or I'm creating a potential independence issue, even if I don't have anything to do with the people auditing that company. You know why? Because maybe, just maybe, I know the guys auditing and I get them to be nicer on the audit in return for my credit card balance dropping away. This is the level of "trust" we have to deal with, because while it sounds stupid, people *will* do it.

If you lie, you've created risk that was *not* intended by the investor. That's what happened with the tranches that CDO packages for housing investment used, the same shit that crashed the housing market and could have collapsed our whole finance system. So please, do not ever invest, because you will get ripped off so fast it won't even be funny. You have no fucking clue.
