I mean, if I tell the bank I'm sing the loan they gave me to buy a house, then I turn around and instead use it to gamble, it doesn't matter if I win. Bank is going to destroy me and I'm going to jail. It's really that simple.

If you're a stickler that has no judge of right or wrong then by the textbook he did lie to investors. Defrauding them means he had the goal to steal their money and not return it. He did NOT do that, he needed the money for a different venture (company) and that company made the investors money. You are jumping through hoops if you're trying to say he had malicious intent. In a jury trial they found him only guilty and a few (maybe up to 3) things, and one of them was lying to investors. They specifically agreed he did not mean malice.

"Gray area things" is exactly why there have to be rules in the first place.

You take money from investor or a bank for a specific purpose, that all parties agree upon. If you use that money for anything else you're a crook.

You invest in a hedge fun because you want a return on your investment. If he took the money and went to Paris and spent it on dope clothes that's different. Instead he had the same goal just in a different company. To turn that money into more money. No matter what you say, you cannot say that he did not behave ethically towards their money. His only crime is lying to them about what was happening with their money. I don't believe he got sued by any of his investors, they aren't pissed. It's the shitty government that wants to make an example out of him.

No it's not. It's called fucking FRAUD for a reason. It doesn't matter if it "works out". You lied, you pulled risky shit that turned out but just as well couldn't have, and in doing so caused risk that a the investors in question did *not* sign up for. The reason you come down on shit like this is because 99% of the time it DOESN'T FUCKING WORK OUT. Letting one person get away with it means you encourage others to do the same.

Let's look at it like this, since you are too dense to understand laws and their reasons apparently:

You are speeding 110 mph down the highway in a 65 zone. The cop pulls you over, despite the fact that you aren't in danger (you drive great at 110 mph) and there wasn't anyone around. Do you think the cop would just go "Oh hell, homeboy- keep on rolling!" or would he nail your ass to the wall? The answer is the latter, because just because you haven't had a high speed accident right then doesn't mean you won't have one the next day you are driving 110 mph down the highway and it's too late when you wipe out that family of four.

THAT IS A FUCKING CRIME!

You pay for an investment to be handled a certain way. If it isn't or if someone lies, you are exposed to risk you did not sign on for nor were you necessarily compensated for that additional risk. Investing isn't a blank check.

Igor- if this is how you truly believe, don't ever invest money. You will be taken to the cleaners so fast it won't even be funny.
